1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the Learn Numbers 123 - Counting mobile application (the "App" or "Services"). By downloading, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy.

The App is provided by Pixibase (referred to as "Pixibase," "we," "us," or "our"). If you do not agree to these Terms, please do not use the App.

2. Eligibility and Parental Consent

Learn Numbers 123 - Counting is designed for children, primarily toddlers and preschool-aged kids. While the App is for children, the agreement to these Terms must be made by a parent or legal guardian.

By allowing your child to download and use the App, you (the parent or legal guardian) represent that you have reviewed and agree to be bound by these Terms and take full responsibility for your child's use of the App.

3. License to Use

Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on your supported devices strictly for your own personal, non-commercial educational use.

All rights not expressly granted to you are reserved by Pixibase. You may not copy, modify, distribute, sell, or lease any part of our App, nor may you reverse engineer or attempt to extract the source code of the software unless permitted by law.

4. Advertisements and Third-Party Services

The App is provided free of charge and is supported by in-app advertisements. Because our audience includes children, we ensure that our advertising partner (Google AdMob) is configured for "Families" or child-directed treatment. This means ads are contextual, age-appropriate, and not based on personalized tracking or behavioral profiling.

Pixibase is not responsible for the content of third-party advertisements or any third-party websites they may link to. Parents are encouraged to monitor their child's use of the App.

5. Intellectual Property

The App, including its educational content, design, graphics, UI/UX, characters, sounds, music, and software code, is owned by Pixibase or its licensors and is protected by copyright, trademark, and other intellectual property laws.

6. Disclaimers of Warranty

The Services are provided "AS IS" and "AS AVAILABLE." Pixibase makes no warranties, whether express or implied, that the App will be uninterrupted, error-free, completely secure, or that it will yield specific educational results for your child.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Pixibase shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your or your child's access to or use of or inability to access or use the App; or (b) any errors or omissions in the App.

8. In-App Purchases and Subscriptions

While the base App is free to download and use, some features, levels, or an ad-free experience may be offered via In-App Purchases (IAP). These purchases require real money and must be made by a parent or adult.

You represent that you are authorized to use the payment method linked to your app store account. We are not responsible for unauthorized purchases made by children if you have not secured your device's parental payment controls.

10. User Content, Storage, and Retention

If the App allows users to generate, upload, store, or otherwise create content, including but not limited to images, artwork, or other media ("User Content"), you retain ownership of your User Content, subject to the rights necessary for Pixibase to operate, improve, and provide the Services.

Pixibase does not guarantee the permanent availability, storage, or preservation of any User Content. Storage is provided on a best-effort basis and may be subject to technical, operational, or business limitations.

For free-tier users, storage capacity and retention duration may be limited. Pixibase may, at its sole discretion, delete, remove, archive, or restrict access to User Content at any time, including but not limited to cases of:

• prolonged inactivity,
• exceeding storage limits,
• system maintenance or optimization,
• changes to product features or service offerings,
• or other operational, technical, or business reasons.

For paid or subscription-based users, Pixibase may provide enhanced storage or retention; however, Pixibase does not guarantee indefinite storage or preservation of User Content for any user tier.

Where reasonably possible, Pixibase may attempt to provide advance notice of significant deletions, but is not obligated to do so.

Users are solely responsible for maintaining backups of any User Content they wish to retain. Pixibase shall not be liable for any loss, deletion, or inability to access User Content.

11. Service Changes and Data Management

Pixibase reserves the right, at any time and without prior notice, to modify, suspend, limit, or discontinue any part of the Services, including features, storage availability, or access to User Content.

This includes the right to:

• enforce storage limits,
• remove or restrict access to content,
• modify or discontinue features that store or display User Content,
• or perform data cleanup necessary for maintaining system performance, security, or business operations.

Pixibase shall not be liable for any consequences resulting from such changes, including the loss or deletion of User Content.

12. Operational and Technical Limitations

The Services operate on infrastructure and systems that may evolve over time. Pixibase makes no guarantees regarding long-term data retention, backward compatibility, or continued availability of specific features.

Pixibase may take any actions reasonably necessary to maintain the integrity, performance, security, or sustainability of the Services, including the removal or modification of stored data.

By using the Services, you acknowledge and accept that data may be modified, relocated, archived, or deleted as part of normal system operation or future changes.

13. Changes to Terms

We may revise these Terms from time to time. The most current version will always be posted on this page. If a revision is material, we will try to provide notice prior to the changes taking effect. By continuing to use the App after those changes become effective, you agree to be bound by the revised Terms.
